Military Law Lawyer Warns About Changes in Summons Delivery.


The lawyer and managing partner of the legal association "Aktum" Olena Khomenko spoke about changes in the receipt of summonses by conscripts. According to the new resolution No. 560, summonses can now be sent by Ukrposhta as valuable letters with a description of the contents. Ukrposhta has already sent more than 6,000 such summonses.
Olena Khomenko emphasized that "the fact of not receiving the summons is automatically equated to the fact of receiving the summons." This means that conscripts should be attentive to their postal correspondence.
The lawyer also reminded about the duty of conscripts to inform about the change of their actual place of residence. This is especially relevant for internally displaced persons (IDPs) who must inform about the new address of their stay.
Concerning valid reasons for not appearing at the territorial recruitment center (TRC), Olena Khomenko noted that if a conscript was undergoing treatment in a medical institution, this is a valid reason for not appearing at the TRC and provides an opportunity to challenge future fines.
However, merely having a valid reason is not enough. The conscript must necessarily notify the TRC about such a reason by sending a valuable letter with a description of the contents through Ukrposhta. This will help to challenge fines or other procedures in the future.
