The Ministry of Justice explained that a power of attorney is a written document issued by one person to another for representation before third parties. A power of attorney allows the representative to act on behalf of the principal, to enter into agreements and other transactions. To carry out transactions with real estate, vehicles, and other property rights, a notarized power of attorney is required. Obtaining a power of attorney for use in Ukraine can be done in two ways. The first is notarizing the power of attorney at the consulate. Such a power of attorney does not require further legalization and translation and is valid in Ukraine from the moment of issuance. The second way is notarizing the power of attorney at a notary in the country of residence. The preparation and drafting of such a power of attorney is governed by the laws of that country. To obtain a power of attorney, you need to have a passport, a registration number of the tax identification card, a copy of the representative's passport, and other documents depending on the content of the power of attorney. You also need to pay the consular fee or the notary service fee. After obtaining the power of attorney, you should take care of its legalization and translation into Ukrainian. The legalization procedure depends on the country where the power of attorney was issued. Powers of attorney issued in Poland or the Czech Republic do not require legalization due to bilateral international agreements between Ukraine and these countries. For other countries, an apostille must be affixed to the power of attorney - a special stamp that confirms the authenticity of the document. After that, the power of attorney needs to be translated and notarized. After these actions, the power of attorney can be used in Ukraine.
