Ukrainians face legal action over fences with neighbors: what is the permissible height.


According to the story of lawyer Yuliia Yurchenko from the law firm 'Maksym Boyarchuk and Partners', Ukrainians have been informed about the permissible height of fences between neighbors. The height of fences is regulated by legislation that defines the list of construction works that can be carried out without permits. Temporary structures, including fences, around individual residential, garden, and cottage plots can be built without obtaining special permits.
However, there are restrictions on the height of fences. The permissible height of a fence from the street is no more than 2.5 meters, and between neighboring plots is 2 meters. Such requirements are established in DBN B.2.2-5:2011 'Landscaping of territories' and are intended to ensure normal lighting and ventilation of adjacent territories.
If the height of a fence violates the rights of neighbors or does not comply with legal requirements, the affected party may turn to the court. The Land Code of Ukraine also obliges landowners to use their land in a way that does not create inconveniences for neighbors.
The lawyer emphasizes the importance of adhering to legal norms and the rights of other land plot owners to avoid conflicts with neighbors and maintain good neighborly relations.
